UK Law On CBD Oil

Its a farce, it’s a joke, it’s constantly changing and the goal posts keep on moving. It really is like the left-hand doesn’t even understand that the right is also a hand and if both worked together could achieve miracles. It’s as though some external force is purposefully forcing the wrong glove onto the wrong hand, yes it has fingers and a thumb but try as you might it will NEVER fit.
Ok rant over but by the end of this trust me if you are not ranting yourself you will get a grip as to why we are.
So where to start
From 1st November 2018 in the UK it became legal for “specialist doctors” NOT general practitioners, to legally prescribe medical cannabis (including both THC & CBD products) to patients that qualify.
The decision to allow this had been a long time coming, but Home Secretary Sajid Javid made the decision to relax the previous legislation which had been in existence since 1971 under the misuse of drugs act.
Recent high profile cases involving many sick children made it clear that our position on cannabis-derived medicine is less than satisfactory and completely outdated.
Javid made the decision to reschedule medicinal cannabis, at least for those suffering from a verified medical condition. Javid is quoted as saying “ I have taken the decision to reschedule cannabis-derived medicinal products”, meaning they WILL be available on prescription. He went on to say that “ this decision will help patients with an exceptional clinical need, but is no way a first step to the Legalization of cannabis for recreational use in the UK”
There you go, folks, that’s the NONE confusing bit Nov 2018 it’s LEGAL “simples” (oops there I go again🐀)
So what does all this mean?
Basically, all UK residents with a qualifying condition are eligible to apply for a cannabis prescription as long as they receive a recommendation from a licensed specialist clinician. The kicker, however, is that the clinician must deem an “exceptional clinical circumstance” exists wherein “no other lawful medicine is available that would meet the needs of the patient”. This means that all pre-existing medicine for said condition MUST have been tried first (even though proven NOT to work arrest the ailments). At the moment there is a vast difference between the CBD oils sold in high st chains such as Lloyd’s pharmacy or Holland’s and Barrett’s, these oils (although pretty harmless) are sold as a food or nutrition supplement and do not offer to help with any medical conditions. ( If they do then the CPD needs to be having a word and taking all suitable legal action to prevent this from re-occurring). Back in 2016 the MHRA acknowledged the benefits of CBD oils but they also made it clear that anyone selling it as medicine must have the products properly licensed as a medicine. This creates a loophole and as long as it’s sold as a supplement with no medical claims offered you are within the law.
So there we go again IT IS LEGAL they sell it on the high street.
So although you can buy CBD on Main Street, you cannot purchase medical grade CBD ?…

So, my friends, it seems that the law will let you buy CBD so long as it’s not CLASSIFIED as medical CBD.
